1. Acceptance of Terms
By accessing or using the Fahali platform (the “Service”), operated by Future Legends Inc (“Company,” “we,” “us”), you agree to be bound by these Terms of Service. If you do not agree, you may not access or use the Service.
2. Description of Service
Fahali is a market intelligence platform that monitors public market data and provides detection signals, risk analytics, and market observations. The Service is read-only by design — it does not execute trades, manage portfolios, or provide financial advice. All signals, alerts, and observations are for informational and educational purposes only.
3. No Financial Advice
Fahali is not a financial advisor, broker, or investment adviser. The Service does not provide personalized investment advice, recommendations, or solicitation of any kind. Nothing on the platform constitutes a recommendation to buy, sell, or hold any security, cryptocurrency, or financial instrument. Past performance of detection signals does not guarantee future results. You alone bear responsibility for your investment decisions.
4. Eligibility
You must be at least 18 years old to use the Service. By creating an account, you represent that you meet this requirement and that all information you provide is accurate and complete.
5. Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts at our discretion.
6. Subscriptions and Billing
Certain features of the Service require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis, as selected during checkout. All fees are non-refundable except as required by applicable law. We may change our pricing with notice. Continued use after a price change constitutes acceptance.
7. Prohibited Conduct
You agree not to:
- Use the Service for any illegal purpose or in violation of any applicable laws
- Attempt to circumvent authentication, rate limits, or access controls
- Reverse-engineer, decompile, or disassemble the Service
- Scrape, crawl, or extract data from the Service without authorization
- Incorporate our signals or data into a competing product
- Use the Service to provide financial advice to third parties
8. Intellectual Property
The Service, including its code, design, signals, algorithms, and content, is owned by Future Legends Inc and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal or internal business purposes in accordance with these terms.
9. Data and Privacy
Our collection and use of your data is governed by our Privacy Policy. By using the Service, you consent to our data practices as described therein. You retain ownership of your portfolio data; we claim no intellectual property rights over it.
10. Third-Party Services
The Service may integrate with third-party platforms (e.g., Binance, Alpaca). We are not responsible for the availability, security, or performance of these third-party services. Your use of connected accounts is subject to the terms of those platforms.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUTURE LEGENDS INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO FINANCIAL LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold Future Legends Inc harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these terms, or infringement of any third-party rights.
14. Termination
We may suspend or terminate your access at any time for violation of these terms or for any other reason with notice. Upon termination, your right to use the Service ceases immediately. Sections 7-13 survive termination.
15. Changes to Terms
We may modify these terms at any time. Material changes will be notified via email or through the Service. Continued use after changes constitutes acceptance of the modified terms.
16. Governing Law
These terms are governed by the laws of the Republic of Kenya, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Nairobi, Kenya.
